Kentucky Supreme Court Decision re: Lexington Smokefree Ordinance

This historic decision from the Kentucky Supreme Court upheld the Lexington Smokefree Ordinance.  In a 6-1 ruling, the Court held that the Lexington Smokefree Ordinance is not preempted by state law and that it is not an improper infringement upon property rights.  With this decision, not only is the Lexington Smokefree Ordinance being enforced, but the door is open for all communities in Kentucky to have the ability to pass smokefree ordinances.
